Acceptance of Terms

By downloading, installing, or using Wagyu ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Wagyu is a portfolio tracking application that allows you to monitor cryptocurrency, stock, and ETF holdings. The App provides tools for tracking asset performance, importing bank transactions via FinTS, and syncing data across Apple devices.

The App is an informational tool only. It does not provide financial advice, investment recommendations, or brokerage services. It does not execute trades or manage funds on your behalf.

No Financial Advice

Nothing in the App constitutes financial, investment, tax, or legal advice. All data displayed -- including prices, charts, and portfolio values -- is for informational purposes only. You are solely responsible for your investment decisions. Always consult a qualified financial advisor before making investment decisions.

Market Data Accuracy

The App displays market data sourced from third-party providers. While we strive for accuracy, we do not guarantee that prices, charts, or other market information are accurate, complete, or current. Market data may be delayed. Do not rely on the App as your sole source for time-sensitive trading decisions.

FinTS Banking Connections

The App allows you to connect to your bank via the FinTS protocol. When using this feature:

• The connection is established directly between your device and your bank's server
• You are responsible for the accuracy of the credentials you provide
• You must comply with your bank's terms of service
• We are not responsible for any issues arising from your bank's systems or the FinTS protocol

User Responsibilities

You agree to:

• Use the App in compliance with all applicable laws and regulations
• Maintain the security of your device and any credentials stored in the App
• Not attempt to reverse-engineer, decompile, or tamper with the App
• Not use the App for any unlawful purpose

Intellectual Property

The App, including its design, code, and content, is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or financial losses arising from your use of the App. Our total liability for any claim arising from or relating to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Third-Party Services

The App may interact with third-party services (market data providers, banking servers via FinTS, Apple's CloudKit for sync). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is subject to their respective terms and policies.

Changes to Terms

We may update these Terms from time to time. Changes will be reflected on this page with an updated date. Continued use of the App after changes constitutes acceptance of the revised Terms.

Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to discontinue the App or any of its features at any time without prior notice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
